Best Business Mastery Affiliate Program
This agreement describes the entire terms and conditions for
participation in the Best Business Mastery Affiliate Program
By filling out the form and hitting 'register' you are agreeing to the below terms.
The Best Business Mastery Affiliate Program is owned and operated by Best Business Mastery LLC. In this agreement, Best Business Mastery is referred to as BBMLLC.
In this agreement, the term "Affiliate" refers to you (the applicant). Wherever the agreement refers to "you" or "your", it means "the Affiliate"; "we" or "our" refers to Best Business Mastery Affiliate Program.
Affiliate Site
Best Business Mastery Affiliate Program will create a unique URL for you when you submit a completed affiliate enrollment form.
Links
As promptly as practicable after the date hereof, BBMLLC will make available to you via (i) graphic and/or textual links, which will establish a direct hyperlink connection from your affiliate website to BBMLLC's Site (each of which is referred to herein as a " Link"). The Links may include, without limitation, a graphic or image of BBMLLC product offers which when "clicked" or selected by a user of the affiliate site, will enable such user to access bestbusinessmastery.com to purchase products. Subject to the terms and conditions hereof, in your discretion, you shall display during the duration of this Agreement some or all of the Links as promptly as practicable after such Links are made available by BBMLLC.
Agreements Regarding Links
(i.)You agree that you will cooperate fully with BBMLLC in order to establish and maintain the Links. BBMLLC will be responsible for providing link access in connection with each Link.
Commissions
You will receive commissions from orders placed through your Affiliate Site. For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered. The commission structure is as follows:
Your Best Business Now Volume 1 -10% of Each System Sold on Affiliate Site (Currently $97 per sale) or sales of individual audio products.
Payment
In order to receive payment for the earnings you've generated you must complete your payment details. BBMLLC makes payments every month and pays on Net 45 terms. This means you will receive your payments approximately 45 days after the end of the month via check. If there are any chargebacks from your affiliate sales, the amount will be deducted from the next monthly payment. If there is no subsequent payment, the Affiliate will be invoiced for the chargeback.
A minimum of $50 needs to accumulate in your commission account before a payment will be processed.
Order Fulfillment
BBMLLC will be solely responsible for processing every order placed by a customer on the Affiliate Site.
Customers
Customers who purchase products and services through the Affiliate Program will be deemed to be customers of BBMLLC. Accordingly, all BBMLLC rules, policies, and operating procedures concerning customer orders and service will apply to those customers. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time. BBMLLC policies will always determine the price paid by the customer.
Qualifying Sites
BBMLLC reserves the right not to accept any site into the Affiliate Program based on site content. Sites that Do Not Qualify for the BBMLLC Affiliate Program include sites which:

promote sexually explicit materials

promote violence

promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age

promote illegal activities

violate intellectual property rights
Unsolicited Commercial Email or SPAM
BBMLLC in no way participates in mass unsolicited emailing (i.e. spamming), and all Affiliates are expected to adhere to this policy as well. Violation of this policy will result in the termination of this contract and immediate dismissal from the BBMLLC Affiliate Program, with no refund.
Relationship of Parties
You and we are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. You will have no authority to make or accept any offers or representations on our behalf. You will not make any statement, whether on your site or otherwise, that reasonably would contradict this statement.
Confidential Contract Terms / Pricing
The terms of this Agreement, including but not limited to pricing and compensation, shall be deemed the Confidential Information of each Party. Confidential Information Confidence
The Parties shall keep all Confidential Information in confidence and shall not, at any time during or after the term of this Agreement, without the other's prior written consent, disclose or otherwise make available, directly or indirectly, any item of Confidential Information to anyone, other than employees and agents with a need to know such information and who have agreed to protect such information as provided in this Agreement. The Parties shall use the Confidential Information only in connection with this Agreement and for no other purpose.
Indemnification
BBMLLC and Affiliates shall each indemnify, defend and hold harmless the other Party, its directors, officers, employees and agents with respect to any claim, demand, or cause of action of or initiated by a third party and all resultant loss, debt, or liability, including reasonable attorney's fees, to the extent based upon a claim that, if true, would constitute a breach of any of the indemnifying Party's representations, warranties, or agreements hereunder. The indemnities in this Section are contingent upon: (i) the indemnified Party promptly notifying the indemnifying Party in writing of any claim which may give rise to a claim for indemnification hereunder; (ii) the indemnifying Party being allowed to control the defense and settlement of such claim; and (iii) the indemnified Party cooperating with all reasonable requests of the indemnifying Party (at the indemnifying Party's expense) in defending or settling a claim. The indemnified Party shall have the right, at its option and expense, to participate in the defense of any suit or proceeding through a counsel of its own choosing.
Force Majeure
Neither Party shall be liable for any loss or delay resulting from any force event; provided, however, that if any such force majeure event continues for thirty (30) days or more, either Party may terminate this Agreement upon ten (10) days advance written notice to the other Party. event, including acts of God, fire, natural disaster, labor stoppage, war or military hostilities, disruption of the Internet, or inability of carriers to make scheduled deliveries, and any payment or delivery date shall be extended to the extent of any delay resulting from any force.
Limitation of Liability
We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to you under to this Agreement.
Termination
The term of this Agreement will begin upon our acceptance of your BBMLLC Affiliate Program Application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination provided that either Party may provide written notice via e-mail.
Disclaimers
We make no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
Any disputes between the parties to this agreement which involves interpretations of the terms of this agreement shall be submitted to arbitration under the rules of the American Arbitration Association, and the finding of the Arbitrator shall be binding on all parties. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.
By submitting the Affiliate Order form, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
